Electrical Contractor Pays $500K in Age Discrimination Settlement

Hatzel & Buehler, Inc., a commercial electrical contractor, has recently settled an age discrimination lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC) against its New Jersey branch.

Hatzel & Buehler, Inc., faced allegations of age discrimination in its hiring practices. According to the EEOC’s lawsuit, the Vice President of the company’s New Jersey branch engaged in discriminatory practices by instructing recruiting companies to seek out younger candidates for project manager and estimator positions. As a result, older applicants were excluded from consideration. The lawsuit also alleged that the Vice President failed to retain necessary job applicant and hiring-related records, in violation of federal law.

This conduct is in violation of the Age Discrimination in Employment Act of 1967 (ADEA), which prohibits discrimination against individuals who are 40 years of age or older.

The EEOC, after attempting to resolve the issue through conciliation, filed suit in the U.S. District Court for the District of New Jersey. The parties ultimately agreed to settle the case. The settlement requires Hatzel & Buehler to pay $500,000 in monetary relief to eight older job candidates affected by the discriminatory practices. The company must also implement significant equitable measures to prevent future occurrences of age discrimination.
