The California Supreme Court recently confirmed that when an employer fails to provide a meal or rest period to an employee, or causes them to be missed/interrupted/shortened, then the employer must pay the employee an additional hour of pay for each day that it happens. These are known as Premium Payments. Should the employer fail to pay the premiums, it will be considered a pay stub violation which has its own penalties with a cap at $4,000. Additionally, if the employer fails to pay the premium and the employee is a former employee, then the employer will be liable for a full day’s wages for each day that it fails to make the payment, with a cap at 30 days, which is known as Waiting Time Penalties.
